Terms and Conditions for Hotel Guests

  1. RESERVATION & PAYMENT

Check-In/Check-Out

  • Check-in time: 4:00 PM
  • Check-out time: 11:00 AM
  • Early check-in and late check-out are subject to prior Hotel approval and may incur additional charges
  • The primary guest must be at least 21 years of age. By making a reservation, you warrant that you possess the legal authority to enter into a binding contract and fulfill all financial obligations related to your stay.
  • At the time of check-in, the registered guest must present a valid, government-issued photo ID(such as a driver’s license, passport, or state ID) to verify their age. The name on the identification must match the name on the reservation and the payment method provided.
  • The Hotel reserves the right to refuse service or cancel reservations without a refund if the guest fails to meet the minimum age requirement, does not provide a valid ID, payment method, or the guest provides false information regarding their age during the booking process.

Guarantee & Payment Authorization

  • A valid credit card is required to guarantee a reservation.
  • By providing a credit or debit card, guest authorizes the hotel to charge for the room, taxes, incidentals, and any damages or additional services.
  • A pre-authorization hold will be placed on the payment card for estimated room charges and incidentals for the hotel stay at $100 per night.  Upon guest check-out, room charges are settled and the unused portion of the pre-authorized hold amount will be released.  Please note it may take up to three days or more for the guest’s bank to lift the hold on any remaining funds
  • The guest is responsible for all charges incurred during the stay, including those by additional occupants or visitors.
  • Guest agrees that guest is financially responsible for payment of room, room charges, fees, costs, and damages, including attorney fees and costs assessed by a court.

Cancellation Policy

  • Cancellations must be made at least 24 hours prior to 4:00 PM on the scheduled arrival date to avoid charges of one night’s lodging plus tax based on the guest’s room reservation.
  • Failure to cancel within the required timeframe will result in a charge of one night’s lodging plus taxes based on the guest’s room reservation
  • Early departures prior to the scheduled checkout date may be subject to an early departure fee of one night’s lodging plus taxes based on your room reservation.
  • No-shows will be charged for one night’s room plus taxes based on your room reservation.
  • Special events and group bookings may have different cancellation terms as specified at the time of booking.
  1. OCCUPANCY & GUEST CONDUCT

Room Occupancy

  • Guest shall not exceed the maximum occupancy per room as posted in the guest room.
  • Only registered guests and persons under their custody are permitted in guest rooms overnight.
  • Visitor access to guest rooms permitted during reasonable hours (6:00 AM – 11:00 PM)
  • Hotel reserves the right to refuse service or remove guests for violations of policies or disruptive behavior.

Prohibited Activities

  • No Smoking (including e-cigarettes and vaping) in non-designated areas – violation subject to a minimum $250 cleaning fee
  • No Illegal activities or possession of illegal substances
  • No weapons or firearms (except as permitted by law for law enforcement)
  • No excessive noise or disruptive behavior
  • No unauthorized pets (see Pet Policy below)
  • No tampering with fire safety equipment
  • No commercial or business activities without prior Hotel approval

No jumping in hotel elevators – violation subject to a minimum $250 emergency service fee.

Guest Responsibility

  • Guests are responsible for the conduct of all occupants and visitors to their room.
  • Guests must secure the room and belongings; the Hotel provides an in-room safe for valuables, and guests are encouraged to use it.
  • Individuals under the age of 18 are not permitted to stay in a guest room unless accompanied by a parent, legal guardian, or an authorized adult (18+) for the duration of the stay.
  • The registered adult guest is financially and legally responsible for the conduct of all minors in their party and any damages or disturbances caused during the stay.
  • Hotel reserves the right to refuse service or cancel reservations for guests without a refund for violations of Hotel policies.
  1. LIABILITY LIMITATIONS

Property Liability

  • Hotel is not liable for loss, theft, or damage to guest’s property or their visitor’s property.
  • Hotel strongly recommends guests secure valuables in the in-room safe.
  • Hotel is not responsible for vehicles or items left in vehicles in parking areas.
  • Any belongings left in a guest room will be subject to a safety inspection. Perishables will be disposed of immediately.  Non-perishable items will be kept in Lost and Found for thirty (30) days. Guests shall be responsible for reclaiming items and incurring any related costs. If not reclaimed by the guest within the required 30-day timeframe, the item will be deemed abandoned and either disposed of, donated, or sold.

Personal Injury

  • Guest acknowledges that the stay at Hotel and use of its facilities—including but not limited to the pool, fitness center, spa, parking areas, and common spaces—involves inherent risks of personal injury, illness, or property damage. Guest voluntarily assumes all risks associated with their stay, whether known or unknown.
  • To the maximum extent permitted by law, Guest hereby releases, waives, and forever discharges Hotel, its owners, officers, employees, and agents (the “Released Parties”) from any and all claims, demands, or causes of action arising out of or relating to any loss, damage, or injury, including death, that may be sustained by Guest or Guest’s property while on the premises.
  • Notwithstanding the above, nothing in these Terms and Conditions shall be construed to release the Hotel or the Released Parties from liability for damages or injuries caused by their own gross negligence, willful misconduct, or intentional acts. This waiver applies only to acts of ordinary negligence.
  • Guest agrees to indemnify and hold harmless the Released Parties from any loss, liability, or costs, including attorney fees, that Guest may incur due to Guest’s actions or the actions of any minors under Guest’s supervision while at the Hotel.
  • Guests with medical conditions should consult a physician before using fitness facilities, pool, or spa services.

Force Majeure

  • Hotel is not liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, fire, flood, acts of God, government orders, utility failures, pandemics, or other emergencies.
  • Hotel reserves the right to relocate guests to comparable accommodations in emergency situations.
  1. PROPERTY DAMAGE & ADDITIONAL CHARGES

Damage to Hotel Property

  • Guest is financially responsible for any damage to the room, furnishings, or Hotel property caused by the guest or the guest’s visitors.
  • Smoking in a non-smoking room or non-designated smoking area is subject to a minimum $250 damage fee
  • Additional fees may be incurred to clean excessively dirty or damaged rooms.
  • Guest authorizes Hotel to charge the payment card on file for violations of these damage provisions.

Incidental Charges

  • Incidental charges include room service, minibar, phone calls, movies, internet (if applicable), parking, and other services. Incidental charges will be posted to the guest’s room account.
  • Incidental charges will be settled at checkout or automatically charged to the payment card on file.
  • Disputed charges must be raised at checkout; charges are considered accepted if not disputed within 24 hours of guest checkout.
  1. PET POLICY
  • Pets are not permitted on Hotel property.
  • Registered Service Animals are welcome and exempt from all pet-related fees and restrictions.
  • Emotional support animals do not qualify as registered service animals.
  • Service animals must remain under the handler’s control at all times.
  • Guest is responsible for any damage or cleaning required due to the service animal.
  • Unauthorized pets are subject to immediate removal, and the Hotel may charge the guest a minimum cleaning fee of $250.
  1. PRIVACY & SECURITY

Safety, Security & Right to Enter

  • Hotel staff and management reserve the right to enter any guest room for the following purposes:
  • Routine Services: Scheduled housekeeping, trash removal, and linen changes.
  • Maintenance: Necessary repairs, safety inspections, or addressing mechanical issues (e.g., water leaks).
  • Emergency Situations: Immediate entry in the event of a fire, medical emergency, or threat to guest safety.
  • Policy Violations: Suspected illegal activity, disturbing other guests, or violations of Hotel rules or Terms and Conditions.
  • Safety Checks: Verifying the condition of the room if it has been unoccupied or inaccessible for an extended period.
  • Subpoena: Upon the presentation to Hotel of a valid subpoena issued by a court of competent jurisdiction.

Entry Procedures: 

  • Except in emergencies, staff will follow professional entry protocols:
  • Announcing Presence: Staff must knock loudly and clearly announce their department (e.g., “Housekeeping!” or “Management!”).
  • Wait Time: Staff will wait a reasonable time for a response before using a master key to enter.

Surveillance & Monitoring

  • Hotel maintains video surveillance in public areas for security purposes

Guest Information

  • Hotel collects and maintains guest information in accordance with applicable privacy laws.
  • Information may be used for reservation management, marketing communications, and as required by law.
  • Guest consents to Hotel’s retention of payment card information for the duration of the stay and for the resolution of any disputes.
  1. GAMING FLOOR ACCESS
  • Hotel guests under the age of 18 may walk through the casino without loitering to access a restaurant, convention area, entertainment venue or the swimming pool, but must be 18+ years of age to access the casino and engage in gaming or gaming-related activities.
  • Casino gaming policies, tribal law, and federal regulations apply in all gaming areas.
  • Individuals banned from entering ONGE facilities are prohibited from hotel check-in per gaming regulations.
  • Hotel reserves the right to refuse service to individuals on ban lists.
  1. HEALTH & SAFETY

Emergencies

  • Guests must comply with all fire safety regulations and emergency evacuation procedures. Procedures are available in the room or upon guest request.
  • Tampering with smoke detectors or fire safety equipment is prohibited and subject to fines and/or criminal prosecution.

Infectious Disease

  • Hotel reserves the right to implement health screenings, protective equipment requirements, or occupancy limitations as required by law or public health guidance
  • Guests exhibiting symptoms of contagious illness may be required to quarantine in their room or vacate the property.
  1. LEGAL TERMS

Governing Law & Jurisdiction

  • These Terms and Conditions are governed by the laws of the Osage Nation and, where applicable, the State of Oklahoma and federal law.
  • By staying with the Hotel, Guest consents to subject matter jurisdiction of the Osage Nation Trial court for any dispute arising out of the guest’s stay or these Terms and Conditions. Further, the guest consents to the personal jurisdiction of the Osage Nation Trial Court for any dispute arising out of the guest’s stay or these Terms and Conditions and waives any objection to an inconvenient forum or any other objection to the jurisdiction of the Osage Nation Trial Court.

Severability

  • If any provision is found unenforceable, remaining provisions remain in full force and effect.

Modification of Terms

  • Hotel reserves the right to modify these terms at any time without notice.
  • Current terms are available at the front desk and posted in guest rooms.
  • Continued stay after notification of changes constitutes acceptance of all terms.

Entire Agreement

  • These terms, together with the reservation confirmation, constitute the entire agreement between guest and Hotel.
  • No verbal modifications or representations of any kind are binding on Hotel.
  1. GUEST ACKNOWLEDGMENT

By signing below or completing check-in (including electronic/mobile check-in), guest acknowledges:

  • Guest has read, understood, and agrees to these Terms and Conditions.
  • Guest authorizes charges as outlined above.
  • There may be certain legal rights they are giving up by agreeing to the Terms and Conditions.
  • Guest is at least 18 years of age.
  • All information provided by the guest is accurate and complete.
